Sheriff’s Office: “In Fear of Their Own Personal Safety,” Fatal Shooting Possible Self-Defense

SPRING HILL – Hernando County Officials have released the identities of those involved in last night’s fatal shooting on Villa Court.

According to official, around 5:15 p.m. last night, 911 operators received at least two separate calls from individuals reporting a shooting at 12211 Villa Road. (ORIGINAL NEWS REPORT).

Once deputies arrived on scene, they discovered the body of 28-year-old Brad Anthony Scott, just outside the kitchen window of Joseph and Karen Correa’s residence.

Officials say, “In fear of their own personal safety, one of the residents shot Scott.”

There are conflicting accounts of what actually happened last night, but according to one witness, Joe Correa and the deceased were screaming and yelling, just before he heard at least one shot.

Another witness tells RNRF that Scott may have been attempting to break into the residence, but that has not been confirmed.

Joseph Correa was seen being take from the back of a patrol car in handcuffs and loaded into an ambulance. He was later released and has not been charged in the shooting, according to sources.

  • Some of these comments are simply ridiculous. Saying someone is hallucinating is not justifiable for his actions and let me tell you why and give you an example. You are saying “he was knocking on doors and windows asking for help” so your telling me that if someone is breaking in your window and is beginning to enter your house and you are standing there with a gun pointed at him. Are you going to protect your family or bring him a cup of water and ask if he’s ok or hallucinating? Do you realize how ridiculous that sounds !!!!! Joe and Karen had no friggin clue the guy suffered a seizure and was hallucinating. All they knew was this guy breaking their window and was beginning to enter their home !!

  • The neighbor told me the wife is the one who shot the 28 year old . That the 28 year old was here in Florida to help his family move back to Indiana. He had a seizure & woke up confused & disoriented & was banging on doors & windows for help because he was hallucinating after the seizure. The husband then started arguing with him , in the yard & the wife shot the 28 year old in the head NOT the husband!? The neighbor said the husband was taken by ambulance to local hospital for stress. What a terrible situation for everyone. So so so so sad!!!!!! Prayers to everyone involved!!!!

    If you’re arguing with somebody and you’re on their property you need to leave weather you are right or wrong.

    In a highly publicized move, the Florida Legislature enacted in 2005 what has been popularly known as the “Stand Your Ground” law.
    This law, as outlined in Sections 776.012, and 776.013, Florida Statutes, expands the scope of a self-defense claim traditionally available in a criminal case by:
    * Eliminating the general of “duty of retreat” imposed at common law;
    * Presuming legal justification for the use of force in a person’s dwelling, residence, or vehicle; and
    * Offering immunity from prosecution for individuals who resort to force within the parameters of the statute.
    In its simplest form, the statute provides that a person is justified in the use of deadly force and has no duty to retreat if either:
    * the person reasonably believes that such force is necessary to prevent imminent death or great bodily harm to himself or herself, or another, or to prevent the imminent commission of a forcible felony; or
    * the person acts under and according to the circumstances set forth in Section 776.013 (presuming a reasonable belief as to the necessity of force in the context of ‘dwellings,’ residences, or vehicles).

      (1) A person who is in a dwelling or residence in which the person has a right to be has no duty to retreat and has the right to stand his or her ground and use or threaten to use:
      (a) Nondeadly force against another when and to the extent that the person reasonably believes that such conduct is necessary to defend himself or herself or another against the other’s imminent use of unlawful force; or

      (b) Deadly force if he or she reasonably believes that using or threatening to use such force is necessary to prevent imminent death or great bodily harm to himself or herself or another or to prevent the imminent commission of a forcible felony.

      (2) A person is presumed to have held a reasonable fear of imminent peril of death or great bodily harm to himself or herself or another when using or threatening to use defensive force that is intended or likely to cause death or great bodily harm to another if:
      (a) The person against whom the defensive force was used or threatened was in the process of unlawfully and forcefully entering, or had unlawfully and forcibly entered, a dwelling, residence, or occupied vehicle, or if that person had removed or was attempting to remove another against that person’s will from the dwelling, residence, or occupied vehicle; and

      (b) The person who uses or threatens to use defensive force knew or had reason to believe that an unlawful and forcible entry or unlawful and forcible act was occurring or had occurred.

      (3) The presumption set forth in subsection (2) does not apply if:
      (a) The person against whom the defensive force is used or threatened has the right to be in or is a lawful resident of the dwelling, residence, or vehicle, such as an owner, lessee, or titleholder, and there is not an injunction for protection from domestic violence or a written pretrial supervision order of no contact against that person; or

      (b) The person or persons sought to be removed is a child or grandchild, or is otherwise in the lawful custody or under the lawful guardianship of, the person against whom the defensive force is used or threatened; or

      (c) The person who uses or threatens to use defensive force is engaged in a criminal activity or is using the dwelling, residence, or occupied vehicle to further a criminal activity; or

      (d) The person against whom the defensive force is used or threatened is a law enforcement officer, as defined in s. 943.10(14), who enters or attempts to enter a dwelling, residence, or vehicle in the performance of his or her official duties and the officer identified himself or herself in accordance with any applicable law or the person using or threatening to use force knew or reasonably should have known that the person entering or attempting to enter was a law enforcement officer.

      (4) A person who unlawfully and by force enters or attempts to enter a person’s dwelling, residence, or occupied vehicle is presumed to be doing so with the intent to commit an unlawful act involving force or violence.

      (5) As used in this section, the term:
      (a) “Dwelling” means a building or conveyance of any kind, including any attached porch, whether the building or conveyance is temporary or permanent, mobile or immobile, which has a roof over it, including a tent, and is designed to be occupied by people lodging therein at night.

      (b) “Residence” means a dwelling in which a person resides either temporarily or permanently or is visiting as an invited guest.

      (c) “Vehicle” means a conveyance of any kind, whether or not motorized, which is designed to transport people or property.

  • Some of the post I’ve read on here demonstrate a total disregard for the facts in this case, or the person writing them is just totally ignorant or both. First the victims own Mother stated that her son had been hallucinating and acting strangely. The victim was beating on their doors broke a window and was attempting to gain access to the home. Second, confirmed by gun powder residue test conducted by HCSD the weapon was fired by Karen not Joe. The loss of life is tragic , but unless you were faced with a similar situation you might have reacted in the same manner. that person If someone is attempting to gain access to your knowing that it is occupied I would consider that person to be an immediate threat to me. The victim was not known to Karen or Joe.

    • I’ve had someone enter my garage when my children were younger and I was home alone with them. That was very frightening to me and the kids. I did not shoot our burglar. I had my son get me a rifle while I called 911 and waited for help to arrive. Help arrived within minutes. This is what any sane person does. You don’t shoot someone first and ask questions later. That is not how the law works. There were witnesses to this and hopefully someone has cameras nearby.
      Karen fired the gun huh? The family said they are not making any comments or talking to anyone, so where did you get that info? Joe is pictured in handcuffs. Joe used as racial slur against Brad. There are many facts that the public does not know. There are witnesses which have come forward.
      Maybe we will see the same as the movie theater shooter. He tried self defense, and failed in court and now his family will have huge legal bills for what he felt was self defense. Brad died with his hands in the air, asking for help.

      “Well, it puts you on edge. A little unease,” said neighbor Chris Darby.

      Darby and his family were outside hanging up Christmas lights around their home when the shots rang out.

      “Me and my wife heard three gunshots after an argument, at that point we came to the corner and heard the lady screaming,” said Darby. “My wife called 911, cops came.”

      ABC Action News spoke exclusively with the family of the victim. They’ve identified him as 28-year-old Brad Scott.

      Mother, Marjorie Williams, says her son had been acting strangely and hallucinating after a series of seizures. Her middle child was only in the state to help her move back to their native Indiana.

      She says she saw him loudly knocking on the neighbor’s doors and windows asking for help and claiming someone was following him. That’s when she said he was shot dead on the spot.

      “He was beating on your door,” she cried out, “He was beating on your window why would you take my baby’s life like that?”

      She questions why the family reached for the gun instead of the phone to call 911.

    • I’m not certain how Florida handles trespass but in many jurisdictions for trespass to be upheld, the property needs to be posted as No Trespassing. Notwithstanding even if the property is posted that doesn’t afford the individual to use deadly for because someone is on their property.

  • As a person currently dealing with what sounds to be a similar situation. You have know idea until you have been in the other persons shoes. Law enforcement is” friends” with the neighbors who shoot my dogs with bbgun. Who have killed my papered pedigree cats. Who nightly threaten my family, who have cameras on their fence facing my bedroom window. But when officers come they wont look at the pictures ive taken to prove this. They tell me stop harrasing the old folks. I’m ready to buy a gun. Last year the man who lives in the house shot my husband in the face shattering his eye glasses, we had a witness to the crime. Why would anyone in fear of their own safety leave the inside of their home to confront someone? You arm yourself and call the law. You can’t go out and shoot someone in the head and claim you are in fear of your own safety. This story makes no sense to me.

        • Nobody is taking my guns away. I hope the mother sues the old man but the old man is such a ass wipe, everything is in his wife’s name. It’s pretty bad when a father leaves a home to his grandson and the mother (Karen) bought the house from the son. Brad did not need to die but Joe Correa needs to go to prison. I hope he does.       • I went to warren elementary with brad n tj. Im so sorry this happened. Ive tried to look up brad in the past n bout a week ago to see how hes been since i last seen him in middle school. I could never find a facebook or myspace for him. He was always cool with me. He didnt deserve this. I hope they throw the book at his murderer. N will send a prayer up for u and ur family.
